Los Angeles Dodgers pitcher Trevor Bauer has been placed on administrative leave as California police a Major League Baseball investigate allegations that he sexually assaulted a woman in April and May.
‘MLB’s investigation into the allegations made against Trevor Bauer is ongoing,’ read a league statement on Friday. ‘While no determination in the case has been made, we have made the decision to place Mr. Bauer on seven-day administrative leave effective immediately. MLB continues to collect information in our ongoing investigation concurrent with the Pasadena Police Department’s active criminal investigation. We will comment further at the appropriate time.’
Bauer had been scheduled to start Sunday in Washington, but the team was facing intense criticism from fans and media for the decision to play the reigning National League Cy Young winner as he faces serious allegations.
Los Angeles Dodgers pitcher Trevor Bauer is still expected to start Sunday against the Washington Nationals amid Pasadena ( California ) Police and Major League Baseball investigations into claims he sexually assaulted a woman
New court filings obtained by DailyMail.com on Thursday show Bauer’s accuser (pictured) scratched and bruised after he allegedly choked and punched her while they were having sex
Bauer will not be with his Dodgers teammates when they make a planned stop at the White House on Friday to commemorate their 2020 World Series title, but that’s because the 30-year-old was not a member of that team and only joined Los Angeles as a free agent this year
Dodgers managers Dave Roberts said Thursday that he spoke with Bauer but refused to share details of the conversation before declining to speak any further on the subject. Likewise, Bauer did not speak with reporters on Thursday
New court filings obtained by DailyMail.com on Thursday show Bauer’s accuser scratched and bruised after he allegedly choked and punched her while they were having sex.
The woman, identified as ‘Ms. Hill’ at her attorney’s request, filed for a domestic violence restraining order against Bauer on Tuesday. That petition, which surfaced Wednesday, includes photographs of injuries Hill allegedly suffered during sex with Bauer, such as black eyes and scratches to her face.
Also included are text messages between Hill and Bauer, in which he expresses concern for her injuries, as well as medical documentation for her intercranial hemorrhage, spinal cord injury, and concussion.
Dodgers manager Dave Roberts (pictured) deferred to MLB when speaking with reporters, saying that the decision to start Bauer in Washington is ‘out of our hands.’ ‘I’m in the position of following the lead of Major League Baseball,’ Roberts told reporters Thursday. ‘Their recommendation was for us to … he was our scheduled [starter] Sunday, and to move forward and start that game on Sunday. And so for me to try to read into it anymore outside of what they advised me and us to do, I just choose to follow their lead’
Bauer is currently being investigated in the case by Pasadena (California) police. He previously denied assaulting Hill when the allegations first surfaced earlier in the week, claiming through his attorney that she asked him to be rough during consensual sex. Major League Baseball is ‘looking into the matter,’ according to Tuesday’s league statement.
No charges have been filed against Bauer. A Pasadena Police spokeswoman declined to comment on the department’s active investigation to DailyMail.com on Thursday.
Hill, 27, said she had sexual encounters with Bauer in April and May, but that both episodes turned violent. She specifically alleged that Bauer punched her in the face, vagina, and buttocks, and strangled her with her own hair until she lost consciousness. Hill was later hospitalized for her injuries.
During one encounter, Hill claims she passed out and found Bauer sodomizing her when she regained consciousness.
‘I agreed to have consensual sex; however, I did not agree or consent to what he did next,’ Hill said. ‘I did not agree to be sexually assaulted.’
Hill said she was bleeding and struggling to walk after non-consensual anal sex, but added: ‘In my state at that time, I did not think Trevor was a threat to do anything against my will for the remainder of the night.’
The following day, Hill said, Bauer asked Hill jokingly if she was ‘feeling a little sore this morning?’
Hill said she told him that she didn’t enjoy it and said he seemed to understand.
Also included in the petition were text exchanges between Bauer and Ms. Hill in which she informed him about her injuries
Bauer continued to communicate with Hill over text messages and social media for the next three weeks, discussing baseball and her new job. Some of the conversations were of ‘a sexual nature.’
When the pair met again, Hill said they agreed on a safe word which she says Bauer ignored, choking her until she lost consciousness. When she awoke, he was punching her in the face, she claimed.
‘This was the first punch I felt but it is very possible that Trevor had already been punching and scratching the right side of my face while I was unconscious,’ she said.
‘Trevor then punched me hard with a closed fist to the left side of my jaw, the left side of my head, and both cheekbones. I remember this vividly and it was extremely startling and painful.
‘I was absolutely frozen and terrified. I could not speak or move. After punching me several times, he then flipped me back onto my stomach and began choking me with hair. I lost consciousness again.’
Hill said that she was crying and shaking after regaining consciousness and that Bauer reportedly began to console her, allegedly saying: ‘You’re safe. I’m here. You’re safe… I would never do those things to you if it wasn’t sexually.’
After going to the hospital, Ms. Hill spoke to multiple San Diego Police Department detectives but said she downplayed the alleged incident as ‘rough sex’ and did not reveal Bauer’s name. ‘I was afraid what Trevor would do if he found out,’ Hill said in the restraining order request. ‘I remain afraid that Trevor will find me and hurt me for going to the hospital’
MLB’S DOMESTIC VIOLENCE POLICY ALLOWS COMMISSIONER TO BAN PLAYERS UNDER INVESTIGATION
A joint domestic violence policy adopted by Major League Baseball and the Major League Baseball Players Association allows the Commissioner (in this case, Rob Manfred) to place a player on leave if he is being investigated for domestic violence. That player will continue to be paid.
An excerpt from the MLB rulebook:
‘Under the Basic Agreement, the Commissioner may immediately place a Player accused of a Covered Act on Administrative Leave, effective as early as the date of the Notification, and may keep the Player on Administrative Leave for up to seven (7) days, including the date of Notification, subject to the Player’s right to challenge that decision set forth below. The Commissioner’s Office may ask the Players Association to consent to a one-time extension of the initial seven-day Administrative Leave period for an additional seven (7) days (for a total of fourteen (14) days), which consent shall not be unreasonably withheld. Alternatively, the Commissioner’s Office may defer placing the Player on Administrative Leave until the Player is either charged with a crime by law enforcement, or the Commissioner’s Office receives credible information corroborating the allegations. The Commissioner’s placement of a Player on Administrative Leave shall not be considered disciplinary under this Policy.
‘While on Administrative Leave, a Player shall continue to receive the salary and Major League service to which he otherwise would be entitled but for his placement on Administrative Leave.’
When she returned from Pasadena to San Diego the following day, Hill experienced severe headaches and began vomiting. After speaking with friends, she checked herself into a local emergency room where she told medical staff what happened to her.
In a subsequent text message exchange included in the petition and reviewed by DailyMail.com, Hill told Bauer that doctors thought the ‘bruises/swelling’ on her face would last another week, but that she wasn’t sure when her ‘head symptoms’ would subside.
‘I just want it all to go away,’ she wrote Bauer.
‘I feel so bad that this happened,’ he responded. ‘Wish I could be there with you through it.’
‘Just grateful that you are showing that you care,’ she wrote.
‘I do. I absolutely do,’ he texted her. ‘Never want to see you hurting.’
After going to the hospital, Hill spoke to multiple San Diego Police Department detectives but said she downplayed the alleged incident as ‘rough sex’ and did not reveal Bauer’s name.
‘I was afraid what Trevor would do if he found out,’ Hill said in the restraining order request. ‘I remain afraid that Trevor will find me and hurt me for going to the hospital.’
In the document, Hill explained that she spoke with Bauer by phone at the instruction of police, who were recording the call.
During that conversation, Hill said she asked Bauer: ‘What did you do to me when I was unconscious?’
In response, he allegedly admitted that he had repeatedly punched her in the buttocks. She said that he changed the topic when she said she did not consent to being punched.
Hill claimed that the call ended with Bauer acknowledging that he punched her and asking how they could move forward and if he could contact her.
‘I told him that he could because I did not know if the police still needed to collect more messages from him as evidence,’ she said. ‘It is my understanding that there is an open criminal investigation. I have not been informed whether the proper authorities intend to arrest and press charges against Trevor.
‘I intend to comply with whatever is requested of me in connection with criminal proceedings,’ she continued. ‘As the shock has worn off, I recognize the seriousness of the sexual assault I endured. I do not want Trevor to put anyone else through what I suffered.’
In one of her last messages to Bauer, Hill claims she told him the best way for him to help her would be to ‘never do this to anyone else ever again.’
‘I would never do anything to hurt anyone,’ he responded. ‘That includes you.’
On May 21, three days after their second and final sexual encounter, Pasadena Police had the accuser ask Bauer for a phone call, which they planned to record. In the text exchange pictured above, Hill is seeing telling Bauer ‘hearing your voice would help’ and he responded by asking her if she wanted to discuss the incident
A hearing has been scheduled for July 23 to determine if the domestic violence restraining order will become permanent, Hill’s attorney, Marc Garelick, told CNN. His team confirmed to The Athletic that they intend to participate in the hearing.
No charges have been filed against Bauer.
On Tuesday, Hill’s lawyer, Marc Garelick, said he expects criminal charges to be pressed following the conclusion of the investigation into his client’s claims.
‘Our goal is to keep Mr. Bauer from contacting our client in any way possible,’ Garelick said in reference to the request for the restraining order.
‘We anticipate there will be criminal action against Mr Bauer, and it is our hope law enforcement will take our client’s allegations and case seriously.’
Bauer’s laywer, Jon Fetterolf, insisted the encounters between the player and Hill were ‘brief and wholly consensual’ and had been initiated by her in April 2021.
Fetterolf said on Tuesday: ‘We have messages that show [Hill] repeatedly asking for ‘rough’ sexual encounters involving requests to be ‘choked out’ and slapped in the face.
‘In both of their encounters, [Hill drove from San Diego to Mr Bauer’s residence in Pasadena, California, where she went on to dictate what she wanted from him sexually and he did what was asked.
‘Following each of her only two meetings with Mr Bauer, [Hill] spent the night and left without incident, continuing to message Mr Bauer with friendly and flirtatious banter.’
In one of her last messages to Bauer, Hill claims she told him the best way for him to help her would be to ‘never do this to anyone else ever again’
Fetterolf said that Hill told Bauer that she was concussed, following their second meeting.
‘In the days following their second and final encounter, [Hill] shared photos of herself and indicated that she had sought medical care for a concussion.
‘Mr Bauer responded with concern and confusion, and [Hill] was neither angry nor accusatory.’
Bauer is known as an active Twitter user. He’s previously engaged in several conspiracy theories, like the unfounded claim that former President Barack Obama was born outside the United States. He also frequently criticizes the media for its coverage of President Donald Trump
He said the pair have not been in contact for a month, or seen each other in over six weeks.
Fetterolf added: ‘Her basis for filing a protection order is nonexistent, fraudulent, and deliberately omits key facts, information, and her own relevant communications.
‘Any allegations that the pair’s encounters were not 100% consensual are baseless, defamatory, and will be refuted to the fullest extent of the law.’
The Dodgers were made aware of the allegations Tuesday and have contacted MLB, which will ‘be handling this matter,’ the team said in a statement.
‘The Dodgers take any allegations of this nature very seriously, but will have no further comment at this time,’ read the team statement.
The California-born Bauer ranks among baseball’s best pitchers and won the National League Cy Young award last season as a member of the Cincinnati Reds. He last pitched on Monday, yielding two runs over six innings in a win over the San Francisco Giants.
He celebrated his impressive 2020 season by inking a three-year, $102 million contract with the Dodgers before the 2021 campaign.
Prior to his successful one-year stint with Cincinnati, Bauer pitched for the Cleveland Indians and Arizona Diamondbacks. He also played collegiately at UCLA where he set a single-season Pac-12 strikeout record.
A formal hearing is scheduled for July 23, during which Bauer will have the opportunity to respond to the allegations. His team confirmed to The Athletic that they intend to participate in the hearing. No charges have been filed against Bauer
