Prosecutors decline to charge owner of two pit bulls that escaped and killed neighbor’s toddler

New Jersey prosecutors have declined to file charges against the owner of two pit bulls that killed a three-year-old boy and wounded his mother on March 16.  

Aziz Ahmed died after the two unregistered dogs broke into his backyard and attacked him and his mother in Carteret.

The Middlesex County Prosecutor’s Office said investigators determined that they did not find ‘intentional, knowing, or reckless criminal conduct’ on the part of the dog owner, whose name was not immediately known.

The letter, written by prosecutor Yolanda Ciccone, was sent to supporters of the Ahmed family on March 23, according to NJ Advance Media.

‘In this case, based upon the information known at this time, it would appear as if no law has been violated,’ the letter reads, according to the outlet.

‘Thus, despite the well-intended demands for justice, no charges will presently be filed. Again, this decision is based upon the facts and evidence known to law enforcement at this time.’

There are no state laws in New Jersey specific for dog attacks and prosecutors have to find ways to prosecute pet owners under existing laws.

A vigil was held in the young boy’s memory on Sunday where attendees called for lawmakers to pass ‘Aziz’s Law’ which would allow the owners of killer dogs to face criminal charges.

‘If there is no law, we will fight to make a law,’ Oma Morgan, a co-worker of Aziz’s father Tanveer, told the outlet.

‘They hold people accountable for jaywalking or letting a dog poop on your front lawn.’

She previously told the outlet: ‘How do you comfort someone who loses a three-year-old? Now his wife, we don’t when she’s going to be okay, she’s never going to be herself again.’ 

The Coney Island Auto Parts in Avenel where Tanveer Ahmed works has started an GoFundMe to help pay for his young son’s funeral expenses that has since raised more than $225,000.

‘The young mother fought with all she had to save her little boy despite her efforts to save her son his injuries were to severe even with the help of first responders little Aziz could not be saved,’ the GoFundMe reads.

‘As for Aziz’s mother she is still fighting for her life and needs multiple more surgeries, she will never full recover form the scars she now has to live with.’

A neighbor said the dogs have bitten a number of residents who know to avoid walking near the home where the pit bulls live, WABC-TV reported.

The pit bulls, which the New York Post identified as being named Logan and Rocky, had somehow slipped past a fence into the backyard.  

Aziz was airlifted to a hospital after the attack and aerial footage from NBC4 showed first responders performing chest compressions on him. 

The dogs had previously been reported to the police in October when residents had reported that they were loose in the neighborhood, a Carteret spokesman told NJ Advance Media.

Both dogs have since been euthanized Carteret Mayor Daniel J. Reiman previously told the outlet in a statement.

‘As a small community, our Carteret family mourns the heart-wrenching loss of our young neighbor and we pray for this young mother and family in this time of unimaginable grief,’ Reiman said.

Patch had reported that when Carteret cops shot one of the pit bulls immediately when they arrived at the scene and the other was euthanized later.
